Whakaata Māori ‘Something for the People’ Giveaway Terms and Conditions

1. These Terms and Conditions relate to the giveaway promotion provisionally called “Whakaata Māori ‘Something for the People’ Giveaway” (“Promotion”).
2. Your entry into the Promotion is deemed to be acceptance of these terms and conditions.
3. The Promoter is Māori Television Service ,trading as Whakaata Māori, (the “Promoter”), acting through Whakaata Māori Channel, Te Reo Channel (“Whakaata Māori Channels”), Whakaata Māori official social media accounts, including but not limited to Facebook account and Instagram account (“Social Media Accounts”).
3. The Promotion commences on 26 April 2023 and closes on 4 May 2023 at 4.59pm (“Promotional Period”). Entries received outside of the Promotional Period will not be accepted.
4. Employees and independent contractors (and their immediate family members) of the “Promoter”, its retailers, suppliers, associated companies and agencies are not eligible to enter. Employees and independent contractors of the Government, crown agencies and/or crown entities must adhere to gift and ethics policies applicable to them when entering the Promotion or accepting any prize.
5. Any New Zealand citizen, over the age of 18 years is eligible to enter the Promotion during the Promotional Period.
6. To enter you are required to:

2. Name something in te reo Māori
7. You can enter as many times as you like.
8. There will be one (1) winner. The winner of the prize will be chosen at random using the Randomizer app. The winner will be contacted via Meta Messenger and asked for their personal email by the Promoter. The Promoter will send a direct email to the winner, announcing their win. The Promoter’s decision is final, and correspondence will not be entered into with any entrant.
9. The prize for the promotion is SOMETHING YOU LOVE / WANT: One (1) A3 TukuTuku board from Whatu Creative (value $16NZD), SOMETHING YOU NEED: One (1) Kaupapa Board Game (value $99NZD), SOMETHING YOU WEAR: One (1) $150NZD gift card from Cravass Clothing (value $150NZD), SOMETHING YOU READ: One (1) Kāwai by Monty Soutar (to the value of NZD $34.99) to (1) one individual winner. The winner will need to provide a valid New Zealand address for the prize to be couriered to.
10. The Promoter may request proof of identity, and/or proof of entry validity. If such proof is not provided by the winner or is not sufficient to be acceptable to the Promoter, then the winner will be deemed to have forfeited their prize.
11. The winner must respond to the above email (described in term 9) within (3) three working days and provide the Promoter with complete and accurate information. If the winner fails to respond and provide the Promoter with complete and accurate information within (3) three working days they will be disqualified, and a new winner will be drawn.
12. By participating in the Promotion you will be providing your information to the Promoter and not to Facebook or Instagram or any other third-party social media platform. This Promotion is not sponsored, endorsed or administered by, or associated with Facebook or Instagram or any other third-party social media platform.
13. All entries become the property of the Promoter. By participating in the Promotion, you are transferring all rights, title and interest (if any) vested in your entry to the Promoter, including, without limitation, copyright, format rights, and all ancillary rights, in the results and proceeds of its activities and/or third-party producer’s services in all media throughout the world for all purposes for the full period of copyright.
14. The prize cannot be exchanged for cash.
15. The prize is not transferable. If the winner is unable to accept their prize, the Promoter may disqualify the winner, and a new winner will be drawn.
16. If the winner accepts a prize, they will be solely responsible for all fees and costs (if any) associated with accepting the prize.
17. By participating in the competition, the winning entrant permits their name, image and likeness appearing in connection with the Promotion, the Promoter or the advertising or marketing, in any media whatsoever throughout the world.
18. The Promoter, its suppliers, associated companies, and agencies will not be liable for any direct, indirect, or consequential loss or damage whatsoever, which is suffered because of your participation in the Promotion or winning any prize.
19. The Promoter is not responsible for any errors that may occur during the Promotion or in the awarding the prize. They accept no liability for any errors.
20. The Promoter reserves the right, at any time to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions.
21. The Promoter’s decision in relation to the winner, or any other aspect of this Promotion, is final and no correspondence will be entered into.
22. The Promoter may modify these Terms and Conditions at any time without notice. The Promoter reserves the right to cancel, suspend or change the Promotion or any element of the Promotion for any reason, including any cancellation, suspension or change necessitated by any event outside of The Promoter’s control.
23. You are responsible for all content submitted as part of your entry. The Promoter shall not be liable for the breach of any third party’s rights as a result of your entry.
24. The Promoter may remove any content from the Promotion from its social media accounts without notice, for any reason whatsoever.
25. You agree that you will not submit any content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, containing offensive language, objectionable with respect to race, religion, origin or gender, or otherwise unsuitable for publication;
26. You will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
27. No responsibility is accepted by the Promoter for entries that are late, misdirected, incomplete, illegible, or lost, incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access telecommunications network services, or any other error or malfunction whatsoever, and is in no way liable for any entries not lodged, or incorrectly lodged, in the Promotion database.
28. All entries and their records become and remain the sole property of the Promoter.
29. The personal information you provide to the Promoter will be stored on the Promoter’s systems and used for the purposes expressed under these Terms and Conditions. Any personal information in your entries will be subject to Facebook or Instagram terms and privacy policies, which can be found at: https://www.facebook.com/legal/terms/update and https://help.instagram.com/581066165581870.
30. You have the right to access and correct or ask for deletion of your personal information by contacting the Promoter in writing by sending a direct message to the Promoter’s social media accounts. If you have any questions regarding the promotion, please contact the Promoter at Contact Us.
